Abstract

La modernisation de la mise en œuvre des règles de concurrence, initiée par la Commission européenne à partir de 2005, repose sur une approche plus économique. Celle-ci vise à fonder les décisions sur une évaluation des effets nets des pratiques sur le bien-être du consommateur. L'essor de l'économie numérique, qui se caractérise par des décisions reposant sur l'exploitation de données massives par des algorithmes, pose de nouveaux défis aux autorités de concurrence. Cet article montre les difficultés induites en matière de délimitation des marchés pertinents, de qualification des pratiques de marchés et de balance des. A ce titre il s'interroge sur la possibilité d'une régulation des algorithmes par les algorithmes eux-mêmes au travers de leur utilisation dans le cadre des procédures concurrentielles et dans celui d'une réglementation ex ante.
