Abstract

En tant que système répressif, le mécanisme disciplinaire est considéré comme juste si la sévérité des peines est proportionnelle à la gravité des infractions jugées. Notre recherche propose donc d'étudier la qualité de la sanction disciplinaire à travers l'étude des données disciplinaires d'organismes professionnels comptables français et américains. A l'aide d'une typologie construite à partir de la littérature, et de méthodologies issues de la criminologie, nous établissons une échelle des fautes disciplinaires, préalable essentiel à l'étude du lien entre manquements et sanctions. Notre étude empirique fait émerger cinq propositions, qui mettent en évidence la perméabilité des organismes professionnels aux attentes de leur environnement économique et financier. L'importance du mécanisme disciplinaire dans la quête de légitimité des organismes professionnels comptables est ainsi particulièrement mise en exergue lors des scandales financiers et dans les pays où l'Etat a un pouvoir de régulation fort.
