Abstract

Plus de 20 ans après la création de la Free Software Fondation par l'emblématique Richard Stallman, les logiciels libres demeurent au coeur de l'actualité des Technologies de l'Information et de la Communication (TIC). Considérés naguère par Microsoft comme le "cancer de la propriété intellectuelle" (Steve Ballmer), les logiciels libres constituent une source (inépuisable ?) de questionnements juridiques et techniques pour les avocats et les juristes chargés dans les entreprises ou les administrations de rédiger les contrats les concernant. Ainsi comment sécuriser les contrats portant sur le développement de logiciels incorporant des composants libres ? Quelle méthodologie faut-il employer pour s'assurer de la traçabilité de ces composants dans les processus de développement de "logiciels propriétaires" ? Quel est l'état de l'art juridique concernant l'écosystème foisonnant des différentes licences de logiciels libres (GNU GPL, CeCILL...) ? Quelle est la portée de la jurisprudence récente sur les projets de développement et de commercialisation de logiciels libres ? L'objet de cette conférence est de faire le point sur ces questions et, plus généralement, d'analyser quels sont les enjeux et l'impact des récentes mutations technologiques (Cloud Computing, Saas...) vis-à-vis de l'Open Source et des logiciels libres.
