Abstract

L'ordonnance du 13 avril 2017 se présente comme une réforme de la gestion des personnels des administrations, permettant de décloisonner les trois fonctions publiques. Derrière l'incantation managériale, on peut y entrevoir un mouvement plus profond qui réinterroge une vieille question de la fonction publique : faut-il parler de fonction(s) publique(s) au singulier ou au pluriel ? Le balancement entre unité et diversité est constitutif de notre fonction publique à trois versants et illustre l'ajustement permanent du droit des fonctionnaires à notre État, par principe unitaire et attaché à la tradition jacobine mais promouvant la décentralisation de la République comme la gestion autonome des services publics. Par la mise en place de dispositifs statutaires communs à des agents relevant de fonctions publiques différentes, l'ordonnance du 13 avril 2017 semble faire triompher le singulier.
