Abstract

Les buts de la régulation économique et financière impriment profondément le droit de la régulation mais semblent avoir considérablement évolué depuis une trentaine d'années. Ainsi l'objectif traditionnel de la construction de marchés concurrentiels, dans des secteurs anciennement sous monopole ou très fortement réglementés, est complété par de nouveaux objectifs extraconcurrentiels. La diversité des buts assignés aux régulateurs oblige les autorités de régulation à opérer une conciliation des objectifs au risque de dénaturer leur office.
