Abstract

La préoccupation d'étudier les mutations de nos finances publiques m'a aussi amené à approfondir l'étude du principe de sincérité budgétaire à la lumière de son inscription dans la Constitution par la loi n°2008-724 du 23 juillet 2008 de modernisation des institutions de la Ve République. Nous rappelons dans cette étude le cheminement du principe de sincérité jusqu'au rang juridique suprême avant d'apprécier si cette consécration pourra avoir un impact sur les pratiques budgétaires de l'Etat. Si cet ancrage conforte les acquis de précédentes lois organiques, il ne rend pas en lui-même le principe plus effectif car l'on reste en présence d'un principe aux contours juridiques flous. Son application reste empreinte de subjectivité (pour la sincérité budgétaire surtout) et donc sujette à interprétations divergentes. Mais son inscription dans la Constitution renforce sa vocation éthique et sa capacité d'influence sur les pratiques budgétaires publiques.
