Abstract

En transposant en droit local la généralisation de l'interdiction des droits exclusifs d'importation prévue dans les autres outre-mer français par la loi Lurel, le législateur polynésien a souhaité faire bénéficier les entreprises polynésiennes d'une période de transition. Les entreprises polynésiennes avaient ainsi la possibilité de saisir, pendant une année complète, l'Autorité polynésienne de la concurrence (APC) pour bénéficier de son expertise dans l'évaluation de la licéité de leurs actes. Cette période pédagogique vient de prendre fin, sans qu'elle ait pourtant utilement été mise à profit, la communication de l'APC n'ayant pas relayé la volonté protectrice du législateur. Un constat qui n'est pas sans conséquence sur les risques qui pèsent dorénavant sur les importateurs polynésiens.
