Abstract

Le principe du pollueur-payeur est l'un des piliers du droit environnemental européen. Il consiste à faire internaliser par le pollueur le coût des pollutions qu'il génère. En vertu de ce principe, la directive européenne 2002/96/CE transposée dans le droit français par le décret n°829 du 20/07/2005, impose aux producteurs d'équipements électriques et électroniques (EEE) de contribuer à l'élimination en fin de vie des produits qu'ils ont mis sur le marché. Ce cout d'élimination doit apparaitre distinctement sur la facture de vente de chaque nouvel équipement. il est appelé contribution visible ou éco-contribution. Son affichage set obligatoire dans le cas des EEE ménagers.
