Abstract

La Fonction publique au sens large représente plus d'un cinquième de l'emploi total. 71% des agents publics sont des fonctionnaires qui appartiennent à un corps ( ou un cadre d'emploi pour la fonction publique territoriale)., c'est-à-dire un ensemble de fonctionnaires soumis au même statut particulier, dans lequel ils peuvent faire carrière. Pourtant, alors que la loi du 13 juillet 1983, loi fondatrice du statut général des fonctionnaires, pose le principe de l'occupation des emplois civils permanents par des fonctionnaires, et que les possibilités de faire appel à des agents non-titulaires sont fixées de manière limitative, le recours aux non-titulaires s'est accru en dérogation à ce principe. Après avoir décrit la très grande hétérogénéité des statuts et des situations d'emploi, Florence Audier observe qu'une plus grande diversification des formes d'emploi, au-delà de ses répercussions sur la fonction publique, ne serait pas sans conséquences sur le service public lui-même.
