Abstract

Les formes d'organisation de la production (sous-traitance, mais aussi externalisation, délocalisation, création de réseaux d'entreprise, groupes...) remettent en cause les frontières de l'entreprise, ce qui a des conséquences sur les relations de travail et les conditions d'application du droit du travail, mais aussi sur les mesures de la performance économique. La sous-traitance ne constitue pas un mode innovant d'organisation du travail, mais ses formes contemporaines remettent en cause les protections traditionnelles des salariés dans le cadre de rapports de dépendance liés à la division du travail intra et interentreprises. Dans ce contexte, c'est la responsabilité de l'emploi et la portée du droit du travail qui se trouvent questionnées.
