Le droit communautaire de la concurrence appliqué aux activités portuaires

Abstract

La prohibition des ententes anticoncurrentielles et de l'abus de position dominante constituent avec le contrôle des opérations de fusion et acquisition les principales règles de droit de la concurrence communautaire. A l'occasion de décisions relativement nombreuses et intéressant des ports d'importance économique inégale, la Commission Européenne a pu, sous le contrôle de la CJCE, développer un corps de décisions au fil desquelles elle a parfait sa connaissance des spécificités du monde portuaire international. L'article passe en revue les décisions les plus importantes dans chacun de ces domaines. Il insiste sur les concepts de marché pertinent (produit et géographique) et de facilité essentielle applicables aux entreprises portuaires et met en évidence le caractère stratégique de ce droit pour l'avenir des ports européens.
