Abstract

While the US Supreme Court seems to reject the Essential Facilites Doctrine, in the European Union this rule is not only implemented but even extended to intangible assets. In a context characterized by a latent legal uncertaintylikely to make the strategic use of antitrust laws easier, opportunistic undertakings might prefer subvert the competition in bringing a lawsuit against the leader rather than undertake their own investments in R&D. As an illustration of this phenomenon, we provide an economic analysis – carried out through the firms' legal strategies prism – of the recent litigation relative to the French press distribution service industry.
