Abstract

Le droit et l'économie jouent de nouvelle manière sur les banques. Plus ordinaires, celles-ci sont aussi plus spécifiques, tentées par des règles souples conçues par des pays attirants, tout en étant tenues plus fermement par les régulateurs. Richesses et risques jouent différemment. S'y articule un nouveau droit bancaire, plus soucieux d'économie, paradoxal parce qu'il fait proliférer ensemble une réglementation propre et le droit ordinaire. Aux textes s'ajoute le juge, par des jurisprudences récentes ayant des visées expressément économiques et systémiques. Aux banques de jouer entre ces règles, et ces personnages aux pouvoirs et à l'esprit nouveaux, sans que la prévention du risque systémique en souffre.
