Abstract

This ruling given by the Criminal chamber of the french Court of cassation contributes to improve the legibility of the criminal law. It brings some clarifications about functions of the "article préliminaire" of the Code of criminal procedure in nullities of instruction theory. Commented ruling concerns police custody decided on rogatory letter (art. 154 C.P.P.). It affects the nullity of the custody of police because of the late information of the examing judge, and the non freeing of the suspect despite the decision of the examing judge.
