The Unspeakable One. De l'activation de la théorie des facilités essentielles dans l'économie numérique

Abstract

Les décisions Google Shopping de juin 2017 et Google Android de juillet 2018 ainsi que l'intérêt que porte la Commission européenne aux plateformes d'intermédiation en ligne conduisent à s'interroger sur une possible activation de la théorie des facilités essentielles à des actifs tels des moteurs de recherche, des systèmes d'exploitation mobiles, des plateformes dominante ou encore des données. Ce texte s'attache à l'application de cette théorie controversée aux actifs immatériels avant d'évaluer quels pourraient être les conditions et les effets d'une éventuelle application aux actifs concernés.
