A OCDE e a questão do transfer pricing

Abstract

A OCDE – Organização para a Cooperação e Desenvolvimento Econômico (Organisation for Economic Co-operation and Development - OECD), instituição internacional atualmente composta por trinta e seis países membros, considerada uma das mais relevantes no presente cenário global, dedicase à promoção do desenvolvimento econômico e integração comercial de seus membros por meio da adoção de políticas públicas comuns e uniformização regulatória no âmbito doméstico. O Brasil apresentou seu pedido de acessão à OCDE em maio de 2017 e, desde então, vem se organizando internamente para atender aos requisitos da instituição no que toca à adequação legislativa e regulamentar com o fim de dar prosseguimento ao processo de acessão à Organização. Este estudo traz uma breve análise sobre os pontos sensíveis que o Brasil deverá enfrentar na adequação necessária da legislação tributária doméstica, especificamente quanto ao instituto do Preço de Transferência (Transfer Price ou Transfer Princing) e os impactos do cálculo e dos ajustes dele decorrentes na atividade empresarial de multinacionais com domicílio no Brasil.
