Poniéndole puertas al campo: Notas sobre la reforma de la ley de la cadena alimentaria

Abstract

En esta nota se repasa brevemente la evolución y contenido actual de la ley de la cadena alimentaria, con especial atención a las nuevas disposiciones que prohíben las ventas a pérdidas y a sus implicaciones prácticas. Se argumenta que es muy improbable que tales cláusulas se puedan aplicar de forma efectiva, que si se consiguiera hacerlo habría consecuencias negativas a medio y largo plazo para la eficiencia del sector, y que la única forma posible de implementar algo parecido a lo que busca la ley es mediante el establecimiento de suelos de precios a la vieja usanza, que sólo podrían sostenerse mediante la compra pública de los correspondientes excedentes. La conclusión es que no parece que este aspecto de la reciente reforma de la ley haya abierto una vía novedosa o prometedora para mitigar los problemas del sector, o que su reforzamiento sea aconsejable.
