El Proyecto de Ley de vivienda 2022

Abstract

En esta nota se analiza críticamente el proyecto de ley por el derecho a la vivienda, actualmente en tramitación en el Congreso. Se argumenta que el texto es inconstitucional debido a que invade competencias exclusivas de las comunidades autónomas y altera el contenido esencial del derecho de propiedad en el caso de las viviendas. Por otra parte, algunas de las medidas excepcionales que se introducen en las zonas “tensionadas”, incluyendo los controles de alquileres, pueden ser contraproducentes.
