Abstract

El comercio minorista está sometido a regulación estatal, autonómica y local. El marco establecido por la Constitución de 1978 ha llevado a una creciente intervención y regulación de las comunidades autónomas, dando lugar a una notable diversidad regulatoria en todo el Estado. El Tribunal Constitucional ha debido pronunciarse sobre los conflictos de competencias entre el Estado y las comunidades autónomas en materia de comercio interior en más de diez casos y ha trazado los límites tortuosos en la regulación de esta materia y de otras conexas. Además, la diversidad en las políticas autonómicas tiene un impacto en el crecimiento y desarrollo económico de las respectivas comunidades autónomas.
