Abstract

Este trabajo estudia la jurisprudencia de los organismos de competencia chilenos en el tratamiento de las facilidades esenciales. El estudio de las sentencias muestra que ha existido una especial preocupación por el riesgo de que un monopolio integrado verticalmente sabotee a sus competidores aguas abajo. Por esta razón, los organismos de competencia han requerido al gobierno la regulación tarifaria de aquellas facilidades esenciales que no lo estaban, condicionado la integración vertical a que el servicio no-regulado se preste a través de una filial con giro exclusivo e impuesto condiciones de transparencia en la información con el fin de reducir las ventajas estratégicas de los monopolios integrados.
