Abstract
Los casos de países en desarrollo que, como Argentina y Brasil han avanzado en la legislación y puesta en práctica de políticas de defensa de la competencia, es relevante para el análisis de los desafíos que enfrentarán los países centroamericanos en esta materia. A partir del estudio de las experiencias de aquellos países, se han formulado una serie de recomendaciones entre las que se destaca la importancia asignada al hecho de que exista un organismo único e independiente encargado de aplicar la ley de defensa de la competencia. Por otra parte, para el intercambio de información y la definición de objetivos comunes, resulta imprescindible la articulación entre la política de competencia y el sistema judicial, así como acciones coordinadas y complementarias con organismos reguladores. La promoción de una efectiva cultura de la competencia en la comunidad es también una tarea de la agencia de defensa de la competencia. A partir de la experiencia de Argentina y Brasil, y más aún para países de menor tamaño como los centroamericanos, se requiere implementar acuerdos de cooperación tendientes a fomentar la interacción entre las agencias de competencia de cada uno de ellos. Better practices for defending competition in Argentina and Brasil: useful aspects for Central America Abstract: The experiences of developing countries such as Argentina and Brazil, which have advanced in terms of legislative development of the practices of competition protecting policies, are relevant for conducting an analysis of the challenges faced by the countries of Central America, posed by these matters. As such, the report presents a study on the experiences of these countries as well as subsequent recommendations, among which particular importance was placed on the creation of a unique and interdependent organization in charge of applying the law of defending competition. Enabling an exchange of information and define common objectives requires an concurrence between competition policies and the judicial system, such as coordinated actions in accordance with regulatory organizations. Promoting an effective culture of competition in the community is also a task of the agency for protecting competition. The experience of Argentina and Brazil has demonstrated the necessity of implementing cooperation agreements aimed at promoting interaction between competing agencies of competition, especially for the smaller countries of Central America.
