Eficiencia y congestión judicial en Colombia

Este documento propone el indicador de eficiencia real como el indicador que debe ser usado para medir la gestión del sistema judicial, ya que, a diferencia de otros posibles indicadores (volumen, congestión, eficiencia), este tiene en cuenta las necesidades del ciudadano, que en última instancia, es la razón de existir del sistema judicial. En las actuales discusiones en Colombia, en donde en los últimos cinco anos se han realizado tres reformas a la administración de justicia, es importante resaltar que no es necesario hacer ningún tipo de modificación al marco legal que rige al sector de justicia, tan solo es necesario mejorar los procesos a través de los cuales se administra, función que actualmente tiene el Consejo Superior de la Judicatura (CSJ). En la descripción que se hace al actual sistema judicial, se evidencia que en ningún nivel judicial (juzgados, tribunales, Altas Cortes) existe un manejo óptimo de los procesos que les corresponden, que la problemática es mayor en las Altas Cortes y que los despachos de descongestión resultan ser una respuesta que no es sostenible en el largo plazo. ***** This paper proposes the indicator real efficiency as the indicator that should be used to measure the management of the judicial system because, unlike other possible indicators (volume, congestion, efficiency), this takes into account the needs of the citizen which is, ultimately, the reason for existence of the judicial system. In the current discussions in Colombia, where in the last five years there have been three reforms to the administration of justice, it is important to note that it is not necessary to make any modifications to the legal framework for the justice sector; it is only necessary to improve the processes through which is administrated the justice, function currently held by the CSJ. In the description made to the current judicial system, there is evidence in any judicial level is an optimal management of processes, that the problem is greater in the High Courts, and that the offices of decongestion turn out to be a response that is not sustainable in the long term.
