Dificultades De Interpretación De Los Convenios De Doble Imposición

Abstract

ResumenEs innegable la importancia que revisten los Convenios de Doble Imposición, CDI, para el derecho tributario colombiano, que apenas de manera tímida empieza a asomarse al derecho internacional tributario. Este documento presenta una reflexión sobre algunas dificultades que su aplicación e interpretación ofrecen en relación con los ordenamientos internos, para lo cual se plantean aproximaciones a su concepto, a sus principios y a algunas de sus características esenciales. Se exponen los contextos internacionales en que se celebran y se plantean algunas de las problemáticas analizadas. Se concluye con algunos puntos sobre los que no hay unanimidad doctrinal o sobre los que es determinante su negociación en los convenios, y otros respecto de los que será necesario seguir trabajando para buscar soluciones efectivas.
