El Fiduciario es la clave del Fideicomiso

Abstract

A lo largo de este trabajo analizaremos el rol decisivo de la figura del Fiduciario en el cumplimiento de las responsabilidades que le impone la ley y las derivadas del negocio subyacente en cada fideicomiso, postulando que las mismas se encuentran complejizadas cuando los proyectos tienen aplicación directa a los negocios de la economía real, que definimos como FID.1 En función del trabajo de investigación realizado, se presentan conclusiones con el fin de realizar un aporte de valor para el desempeño más responsable y profesional de la actividad fiduciaria, lo que redundará no solo en defensa de la figura del fideicomiso, sino también en mayor beneficio para la comunidad por fortalecer el éxito de los negocios apalancados en contratos de esta naturaleza.
