Restitution of Real Estate - the Polish Case

Abstract

A lack of the conclusive settlement of property rights poses a serious problem for the Polish real estate market. The basic element of a developed real estate market is not complete. Fourteen years of transition have not produced any clear solution, successive bills have not found enough political and social support to be implemented. The suspended ultimate clarification of ownership problems in the real estate sector influences investorsÌ attitudes towards that market in Poland. It should also be remembered that an enactment of the restitution act is only a necessary precondition to begin the long process of restitution2. In all likelihood the cases will burden the market for some years to come and the current lack of any clear solution will additionally lengthen this period.
