A Legislação Trabalhista Brasileira E Seus Efeitos Adversos Sobre Os Custos De Transação Na Agricultura

Abstract

Este trabalho pretende contribuir para a análise do padrão inadequado de nosso crescimento agrícola em termos de absorção de mão de obra, focalizando, especialmente, o papel da política trabalhista agrícola. Embora admitindo a importância dos “encargos trabalhistas”, a análise dá mais ênfase aos “custos de transação” decorrentes dessa política; o artigo propõe, na realidade, que esses “custos de transação” sejam mais importantes do que os “encargos trabalhistas” para a análise do papel dessa política. O trabalho termina propondo uma mudança na atual política trabalhista agrícola, tendo em vista permitir que contratos sejam estabelecidos entre as partes envolvidas, de forma muito mais livre do que atualmente. Isso não significa, contudo, que o setor público fique ausente nesse novo mercado de trabalho, inclusive em face de seu papel de garantir o cumprimento desses contratos.-----------------------
