Abstract

Zusammenfassung Vormund oder Betreuer können in verschiedenen Konstellationen in die Lage kommen, einen Nachlass als das von einem Erblasser hinterlassene Vermögen verwalten zu müssen. Im Mittelpunkt steht bei diesen Fällen eine Lage, in der der Mündel oder die betreute Person Erbe oder Pflichtteilsberechtigter ist. In diesen Fällen stellt sich die Frage, welche Pflichten den Vormund oder Betreuer treffen, um entweder die erbrechtliche Berechtigung des Mündels oder des Betreuten realisieren zu können bzw. ob und welche Maßnahmen der Vormund oder Betreuer zu ergreifen hat, um angesichts der erbrechtlichen Lage drohende Haftungsgefahren von dem Mündel bzw. Betreuten abzuwenden. Auf der anderen Seite kommen aber auch Fallgestaltungen in Betracht, in denen es der Erblasser ist, der unter Vormundschaft oder Betreuung gestellt worden ist.
