Abstract

The legal nature of crypto assets is essential for the legal capture of actual transactions. A distinct classification of crypto assets in the legal system creates legal certainty and confidence in the underlying technology. Given the lack of a universal legal definition of the term, both the civil and the regulatory character of crypto assets are widely discussed in the literature. Due to the regulatory focus of this book, we will not discuss the various views on civil law classification. In the following, we will focus on how crypto assets classify under capital market and banking supervisory law and what implications the respective classification entails.
