Abstract

Zusammenfassung Die Folgen des Compliance-Verstoßes erschöpfen sich nicht darin, sich von Mitarbeitern zu trennen, die sich rechtsbrüchig verhalten haben. Vielmehr ist zu klären, welche Schlüsse der Arbeitgeber aus dem Verstoß für sich selbst und seine Unternehmensorganisation zieht: War der Pflichtverstoß Produkt individuellen Fehlverhaltens und damit Einzelfall oder könnten in der Zukunft weitere Verstöße drohen, weil die Organisation des Betriebs Rechtsbrüche dieser Art begünstigt? Ggf. gilt es dann, die betrieblichen Strukturen anzupassen.
