Abstract

Zusammenfassung Der Beitrag bereitet den Weg zur Anwendung von Blockchain für Unternehmen unter Einbezug einer rechtlichen Perspektive. Einführend werden hierzu die Grundlagen der Blockchain-Technologie sowie die Datenschutzgrundverordnung der Europäischen Union (EU-DSGVO) vorgestellt. Anschließend wird die zentrale Frage diskutiert, inwiefern sich beide Themenbereiche miteinander vereinbaren lassen, damit Blockchains unternehmerische Anwendung finden können. Dabei wird auf die verschiedenen Arten von Blockchains ebenso wie auf Anwendungsbereiche der DSGVO, beteiligte Akteure, zu erfüllende Datenschutzgrundsätze sowie die Wahrung von Betroffenenrechten eingegangen. Es wird gezeigt, welche datenschutzrelevanten Aspekte mit der Blockchain-Technologie (nicht) in Einklang zu bringen sind. Darüber hinaus werden technische und regulatorische Vorschläge unterbreitet und erörtert, um den Datenschutz der Blockchain-Technologie gemäß DSGVO zu optimieren. Abschließend werden Konsequenzen für die Anwendbarkeit der Blockchain vor dem Hintergrund zukunftsfester Geschäftsmodelle in Unternehmen diskutiert.
