Abstract

Zusammenfassung Die Prüfung des vom Unternehmen einzureichenden Berichts erfolgt durch das Bundesamt für Wirtschaft und Ausfuhrkontrolle (BAFA) im Hinblick auf das „ob“ und das „wie“ bezüglich der Einhaltung der Sorgfaltspflichten. Dem BAFA werden weitreichende Ermittlungsrechte eingeräumt. Im Hinblick auf das Betreten von Grundstücken und Geschäftsräumen bestehen rechtsstaatliche Bedenken, zumal dieses Recht keinerlei Einschränkungen wie andere behördliche Eingriffs- bzw. Durchsuchungsrechte erfährt.
