Environmental Federalism in Brazil

Abstract

This chapter by Jatoba reviews environmental federalism in Brazil—a large federal country. The author argues that while the Brazilian Constitution has a strong emphasis on environmental protection, it does not delineate a clear division of responsibility for environmental functions among various orders of government. This lack of clarity contributes to intergovernmental conflicts and impairs the efficiency and efficacy of environmental policies. To overcome this, Brazil, in recent years, has made substantial progress in institutionalizing environmental policy and clarifying the roles of various orders/levels of government.
