Abstract

The H-1B petition is solely the employer’s petition. The employee does not sign any of the documents that make up the H-1B petition and is never involved in the Labor Condition Application (LCA) process. However, the employee has a key role in providing documents and information used in the H-1B petition and has the primary responsibility for securing the H-1B visa after the petition has been approved. It is important to provide information and documents that are accurate and authentic, because you risk your employer’s credibility if they are not. More critically, false information or documents can make you inadmissible to the United States forever.
