Abstract

The 1969 Vienna Convention on the Law of Treaties was designed to provide direction and guidance regarding the complicated legality of primacy between international agreements. Given that three of the top five producers of GM crops (Argentina, Canada and the US) have not ratified the Cartagena Protocol on Biosafety (CPB)Cartagena Protocol on Biosafety (CPB) , and in fact are not even signatories to the Protocol, this could become a contentious issue sooner rather than later. This chapter provides a detailed assessment of the various legal implications pertaining to the applicability of the Vienna Convention to the WTO and the CPB.
