Abstract

Este capítulo analiza el marco legal e institucional referido al cultivo de palma aceitera en el Perú, e identifica y discute algunos elementos que se consideran contradictorios. En la medida en que el cultivo está asociado con prácticas de cambio de cobertura forestal a agraria, la deforestación es el fenómeno que se analiza en mayor profundidad, pero no es el único. Más allá de las cuestiones específicas, el argumento general es el siguiente. Existen algunos instrumentos de promoción de la palma aceitera en el Perú, aunque estos carecen de mecanismos para hacer efectiva su aplicación, por lo que difícilmente se puede hablar de una política (lo que en inglés se traduciría como policy13) de promoción del cultivo. De forma similar, la regulación asociada con aspectos ambientales de la palma aceitera abre ventanas para su incumplimiento, sin que haya mayor coherencia entre el conjunto de normas aplicables para regular los impactos ambientales de las plantaciones.
