Abstract

This chapter explores the critical theory around global constitutionalism, sometimes called ‘new constitutionalism’. It assesses this body of work, highlighting its intersections with debates around globalization. It then provides a critique of this work from the perspective of postcolonial critical theory, arguing that the new constitutionalism discourse remains grounded in Western Modernity.
