Recycling von Einweggetränkeverpackungen in Deutschland: Gesetzliche Regelungen und Funktionsweise des implementierten Pfandsystems

Abstract

Seit über zwei Jahrzehnten steht die Kreislaufführung von Einweggetränkeverpackungen im Fokus umweltpolitischer Diskussionen. Durch die allgemeinen Regelungen der Verpackungsverordnung sowie ihre speziell auf Getränkeverpackungen ausgerichteten Paragraphen versucht der Gesetzgeber, den Kreislauf für (ökologisch nachteilige) Einweggetränkeverpackungen durch Rücknahme- und Pfandpflichten zu schließen. Zudem sollen hohe Pfandbeträge den Kauf ökologisch nachteiliger Getränkeverpackungen eindämmen. Für den Konsumenten besteht allerdings durch die mehrfachen Änderungen der gesetzlichen Vorschriften eine unübersichtliche Situation im Kauf- und Recyclingprozess. Der Arbeitsbericht erläutert deshalb die aktuell gültigen gesetzlichen Regelungen zur Rücknahme- und Pfandpflicht für Einweggetränkeverpackungen sowie das in Deutschland implementierte Rücknahme- und Pfandsystem. Um den heutigen Stand der Pfandpflicht verstehen zu können, werden zunächst die historische Entwicklung der Verpackungsverordnung nachgezeichnet und die aktuell gültigen Regelungen zusammengefasst. Im Anschluss wird erläutert, wie das deutsche Pfandsystem (DPG-System) aufgebaut ist und funktioniert. Dazu werden die wichtigsten Akteure und ihre Rollen vorgestellt sowie die Geld-, Material- und Informationsflüsse skizziert.
