Mitbestimmung ohne Mitbestimmungsrechte? Erkenntnisse aus zwei Fallstudien zum Insourcing von Onsite-Werkverträgen im Einzelhandel

Abstract

Onsite-Werkverträge in der Warenverräumung gehen im Einzelhandel zuweilen mit gravierenden Problemen für den Auftraggeber einher. Trotzdem nimmt das Management diese Werkverträge nicht automatisch zurück. Es bedarf eines Akteurs wie des (Gesamt-)Betriebsrats, der die Rücknahme vorantreibt. Für das Insourcing in unseren Fallstudien spielen die Einführung des gesetzlichen Mindestlohnes und abgesenkte Entgelte für ingesourcte Warenverräumer/innen keine Rolle; entscheidend ist hingegen der kreative Einsatz unterschiedlichster Machtquellen der Interessenvertretungen.
