Abstract

The paper is intended for student use; the content and the structure are composed exactly for the fulfillment of this didactic purpose; it is also intended to be a legal information medium for law enforcement. Starting from this methodological premise, the paper aimed to achieve an assembly – as coherent as possible – fundamental legal notions, an assembly capable of providing a theoretical foundation in which to find, then, the premises for solving – at least in part – the problems of daily practice. For this reason, the theories, concepts, interpretations and applications considered to be significant were sought, chosen and presented – from the rich bibliography that produced the long and continuous research effort; practically, in their intrinsic logic, all the legal institutions that make up the single civil liability system are presented. At the same time, the regulations of material law in the field are presented, observing the need, significance, utility and perspective of the normative approaches of the New Civil Code. The paper wanted, therefore, to provide students not only with a minimal fund of specialized knowledge, but also with a methodology for operationalizing the concepts, for their applied understanding. Moreover, the amount of information it contains and the numerous bibliographical references – doctrinal or jurisprudential – can provide legal practitioners with a real working tool. (The author)
