La responsabilidad derivada del error arbital: Una categoría en contrucción

Abstract

El presente trabajo de tesis estudia las vicisitudes propias del arbitraje como mecanismo alternativo de solución de controversias y aborda una problemática particular: el error arbitral y la responsabilidad que se deriva de este. Para ello se analiza a profundidad el arbitraje en el ordenamiento jurídico colombiano a partir de su evolución histórica, y se estudia el sistema de responsabilidad del Estado por error judicial para llevarla a la disciplina arbitral. Asimismo, se presentan los insumas necesarios para estructurar un esquema de responsabilidad autónomo por daño causado por el yerro en la decisión proferida por los árbitros. Lo anterior, valiéndose de herramientas del derecho comparado, el derecho de obligaciones y de las discusiones doctrinales y jurisprudenciales sobre la naturaleza jurídica de la institución arbitral.
