La responsabilidad extracontractual por el hecho del dependiente del artículo 2349 del Código Civil Colombiano

Abstract

Este texto es un análisis de la responsabilidad civil extracontractual por el hecho del dependiente en Colombia con base en el cual se pretendió analizar, en primer lugar, si el régimen de responsabilidad contenido en el artículo 2349 de nuestro Código Civil es de carácter subjetivo u objetivo, para más adelante profundizar sobre dos aspectos relevantes para la teoría de la responsabilidad civil extracontractual: el fundamento de la institución objeto de estudio y la carga probatoria que las partes del caso concreto deben asumir. Al estudiar la doctrina colombiana del siglo XX hasta la más reciente, y la jurisprudencia que la Corte Suprema de Justicia ha proferido sobre este tema, desde la llamada Corte de Oro hasta la actualidad, se observó la falta de análisis y estudio que existe en Colombia en relación con esta materia. Debido a lo anterior, mediante esta investigación se buscó dar una respuesta a los aspectos mencionados antes.
