Los remedios por incumplimiento en la contratación internacional

Abstract

En este libro el autor aborda el estudio de los anteriores " remedios por incumplimiento" desde la perspectiva del derecho internacional de los contratos, el cual cuentra conformado por diversos instrumentos de distinta naturaleza y, así mismo, con distintos grados de vinculatoriedad, que buscan proporcionar reglas uniformes para los contratos comerciales internacionales. Se analiza, así, la disciplina de los principales remedios por incumplimiento, las condiciones y limitaciones para su ejercicio, sus efectos, las razones que conducen a la existencia de una regulación que privilegia el ejercicio de unos remedios por sobre el de otros, así como las lagunas que existen en dicha disciplina y la forma como las mismas pueden ser integradas en los instrumentos objeto de análisis. Todo lo anterior con el fin de esbozar algunas conclusiones acerca de la forma como se encuentra concebido el sistema de remedio por incumplimiento e la contratación internacional.
