Principio De Completitud Y Creación Judicial Del Derecho

Abstract

La decisión judicial es el tema nodal de este trabajo de investigación laureado, en el que el autor consigue demostrar la hipótesis según la cual la Sala Civil de la Corte Suprema de Justicia tiene legitimidad para crear normas, aun cuando el sistema político jurídico aparentemente no se las reconozca; y lo ha venido haciendo desde el siglo XIX, aunque la misma Corte no lo admita. El trabajo, como dijera Mauricio Rengifo Gardeazábal, uno de los jurados, es agradable, está escrito con rigor y contiene "pequeños tesoros, argumentaciones", pues hay en él un intento muy riguroso de mostrar pruebas en las que la Corte ha creado derecho en el ejercicio de su función y logra convencer. Y, como apuntara Édgar Cortés Moncayo, presidente del jurado, el autor cumplió su compromiso no sólo académico sino personal y ha conseguido poner un punto de apoyo para recuperar la fe del sistema jurídico en sus jueces.
