Abstract

La doctrina afirma frecuentemente que la regla jurídica que figura en las decretales, según la cual el que calla, parece consentir, es de genuina creación del derecho canónico porqye es en este ordenamiento en donde aparece por primera vez como una de las regula iuris.También se dice que el silencio, en lo atinente a los negocios jurídicos, tiene un carácter neutro porque, por regla general, no denota aceptación ni rechazo, caracteristica esta que la hacen derivar del antecedente romano que se expresa como regla jurídica en D.50.17.142, y según la cual el que calla ciertamente que no confiesa, pero, sin embargo, es verdad que no niega.
