Abstract

El artículo 13 de la Constitución Política estableció que el Estado protegerá especialmente a las personas que por su condición económica,física o mental se encuentren en una circunstancia de debilidad manifiesta,lo cual es una garantía derivada del principio de igualdad y no discriminación.La Corte Constitucional ha interpretado que mientras un trabajador se encuentre en una condición de debilidad manifiesta por salud no podrá ser discriminado y menos perder la opción de trabajo que es de donde provienen sus ingre¬sos para su subsistencia y para continuar aportando al Sistema General de Seguridad Social en Salud.Esta interpretación de ía Constitución ha sido eficaz en cuanto a la protección de la estabilidad laboral de los trabajadores,y ha revolucionado el marco legal laboral en cuanto ha obligado a dar un uso diferente a ciertas modalidades contractuales en las que ya no predomina la autonomía de las partes para definir su terminación sino el principio constitucional de no discriminación y estabilidad laboral
