“Los tres tenores” del derecho administrativo en el Externado. Discusión entre Eberhard Schmidt-Assmann, Sabino Cassese y Pierre Delvolvé

Abstract

¿El derecho administrativo es el derecho de la Administración? ¿Por qué y bajo qué supuestos la Administración Pública se rige por normas y esquemas del derecho privado? ¿Podemos hablar de derecho privado administrativo? ¿Los particulares, en sus relaciones civiles y comerciales, son ajenos al derecho público? ¿Estamos asistiendo a la superación de las diferencias entre el derecho público y el derecho privado? Reunidos en un salón de la Universidad Externado, previo a las XV Jornadas Internacionales de Derecho Administrativo, Eberhard Schmidt-Assmann (Alemania), Pierre Delvolvé (Francia) y Sabino Cassese (Italia), discutieron durante más de dos horas alrededor del tema “Derecho administrativo y derecho privado: interacciones”. Los asistentes formularon sus preguntas y el debate se tornó interesante. Tener reunidos en un salón a estos tres maestros interactuando con profesores y alumnos del Externado fue un privilegio. No en vano se ganaron, ese día, el título de “Los tres tenores” del derecho administrativo.
