Defensa técnica del contribuyente del impuesto nacional en Colombia: contenido y limitaciones en el procedimiento administrativo tributario y en el proceso contencioso administrativo

Abstract

Dada la trascendencia del tema tributario en lo que tiene que ver con los derechos administrados, especialmente por la afectación a un bien jurídico dentro del Estado social de derecho, como lo es la propiedad, el presente texto aborda el tema de la defensa técnica de los intereses del obligado tributario en el proceso administrativo y en el contencioso administrativo de carácter tributario, con miras a determinar el contenido y limitaciones del mismo, y con base en ello establecer si la defensa letrada o profesional del contribuyente resulta necesaria para la defensa plena e idónea de los intereses de éste en el proceso administrativo, así como su incidencia en el proceso judicial referente a dicha actuación administrativa, y en la garantía de otros derechos sustanciales como la igualdad y la seguridad jurídica.
