El estudio de títulos. El precedente jurisprudencial

Abstract

El estudio de títulos es el conjunto de conocimientos requeridos para determinar las factibilidad jurídica de cualquier operación sobre un bien inmueble. Lo anterior implica un amplio panorama, pues las relaciones que se presentan sobre los inmuebles son múltiples y por lo tanto abarcarlas de manera absoluta resulta una labor casi que imposible. Pero a pesar de lo anterior, presentamos una serie de temas que consideramos los más relevantes o de mayor sentido práctico para un abogado que se enfrenta a esta tarea, bien sea ocasional o de manera permanente, pero también para todas aquellas personas que se dedican a la actividad de la finca raíz. Todo lo anterior encaminado a buscar una línea de interpretación que permita, de uno u otro modo, cierta estabilidad jurídica y por ende la búsqueda y desarrollo de un principio de justicia.
