El fallo de La Haya y sus efectos en la Reserva de Biosfera Seaflower

Abstract

La declaratoria del Archipiélago de San Andrés, Providencia y Santa Catalina como Reserva de Biosfera Seaflower en el año 2000, por parte de la UNESCO, ha sido la oportunidad perfecta para materializar el concepto de desarrollo sostenible en un ecosistema que ostenta características ambientales, ecológicas, sociales y culturales importantes y particulares en el mundo. La decisión proferida mediante el fallo del 19 de noviembre de 2012 del Tribunal Internacional de Justicia de La Haya, en el diferendo territorial y marítimo de Nicaragua y Colombia, reconoce la soberanía de este último país sobre el Archipiélago de San Andrés, Providencia y Santa Catalina, pero modifica la frontera marítima entre los dos Estados, y le entrega a Nicaragua un área de aproximadamente 75.000 km² de mar, área en la que se encuentra una gran fracción de la Reserva de Biosfera Seaflower. Son considerables los efectos de la decisión de La Haya, e incomprensible la razón por la que Colombia no esgrimió, en el marco de su defensa, la importancia de los recursos naturales que esta área marina alberga, y mucho menos la relevancia de la designación de la Reserva de Biosfera Seaflower por parte de la UNESCO. Hasta el momento, el futuro de esta Reserva es incierto; resulta fundamental la construcción de una estrategia de administración conjunta que favorezca el desarrollo sostenible de esta área de importancia internacional.
