Derecho Internacional de Cambio Climático y retos para Colombia

Abstract

El mercado de carbono ha crecido significativamente desde el año 2003 y se estima que para el 2014 el consumo seguirá aumentando. Este libro muestra que la economía mundial y el sistema internacional de cambio climático ofrecen valiosas oportunidades económicas con la reducción de emisiones de carbono en el sector minero-energético por el impacto ambiental que causa: para el sector financiero, en el desarrollo de la bolsa de mercado nacional, y para el sector agrario, en la generación de ingresos para las comunidades indígenas y campesinas. Esto se dará siempre y cuando Colombia sea capaz de desarrollar sus recursos de almacenamiento de carbono y conservación de la biodiversidad. Esta obra explica el Derecho Internacional de Cambio Climático, sus normas institucionales y procedimientos técnico-económicos, así como los sistemas internacionales de comercio de emisiones de Kioto, y del mercado voluntario. También, expone el estado legal, técnico- institucional y socio-económico a nivel nacional, para que Colombia desarrolle una legislación efectiva sobre el tema. De otro lado, sugiere que el gobierno evite ser propietario único de proyectos de reducción de carbono, su intervención se debe limitar a la supervisión de los entes que interactúen en este. Asimismo, se analiza jurídicamente quién debe tener el derecho de propiedad del carbono y cómo se pueden conectar los proyectos REDD+ con el pago por servicios ambientales, para beneficiar directamente a las comunidades indígenas y campesinas.
